Terms of Service

Plain English summary: Use SentiHome fairly, don't misuse it, keep your account secure. We provide the service in good faith. If something breaks we'll work to fix it, but we can't guarantee perfection.
1. Agreement
By creating an account or using sentihome.app ("Service"), you agree to these Terms of Service ("Terms") with SentiHome, ul. Jasieńska 85L, 80-175 Gdańsk, Poland ("we", "us"). If you do not agree, do not use the Service.
These Terms are governed by Polish law and comply with EU consumer protection regulations. Users in the European Economic Area retain all statutory rights under applicable EU law.
2. Eligibility
- You must be at least 18 years old to create an account.
- You must have the legal capacity to enter into a binding agreement.
- One person may hold one free account. Multiple paid accounts are allowed for separate properties.
- Accounts may not be transferred or sold.
3. Your Account
- You are responsible for keeping your login credentials secure.
- You must notify us immediately if you suspect unauthorised access at admin@sentihome.app.
- You are responsible for all activity that occurs under your account.
- Do not share your account with others. Each user who needs access should create their own account.
4. Plans and Billing
4.1 Free Plan
The Free Plan is provided at no cost, subject to the limits described on the pricing page. We reserve the right to modify Free Plan limits with 30 days' notice.
4.2 Paid Plans
- Subscriptions are billed monthly or annually in advance.
- Prices are in EUR and include VAT where applicable.
- Payments are processed by Stripe. We do not store card details.
- Subscriptions renew automatically unless cancelled before the renewal date.
4.3 Cancellation and Refunds
- You may cancel your subscription at any time from your account settings.
- Cancellation takes effect at the end of the current billing period. No partial refunds for unused months.
- 14-day money-back guarantee: If you are unsatisfied within 14 days of your first paid subscription, contact us for a full refund.
- EU consumers retain their statutory right of withdrawal within 14 days of purchase (Directive 2011/83/EU).
4.4 Price Changes
We will notify you at least 30 days in advance of any price increase. Continued use after the notice period constitutes acceptance of the new price.
5. Acceptable Use
You may not use SentiHome to:
- Violate any applicable law or regulation
- Access or control smart home devices in a property you do not own or have explicit permission to manage
- Attempt to circumvent authentication, scrape data, or reverse engineer the platform
- Send spam, phishing, or abusive content through Telegram integrations
- Probe, scan, or test the vulnerability of our systems without written permission
- Share, resell, or sublicense your account or API access
6. Your Data and BYOK
You own your data. By using SentiHome you grant us a limited, non-exclusive, non-transferable licence to process your data solely to provide the Service.
Your Shelly API key ("Bring Your Own Key" — BYOK) is stored encrypted and used exclusively to communicate with your own devices. We do not use it for any other purpose.

7. Intellectual Property
SentiHome and its content (logo, interface, code, copy) are the intellectual property of SentiHome. You may not copy, modify, distribute, or create derivative works without written permission.
You retain full ownership of your home data (device names, energy readings, custom automations). If you delete your account, we delete your data within 30 days.
8. Service Availability
We target 99.5% monthly uptime for paid plans. We do not guarantee uninterrupted service. Planned maintenance will be announced with at least 24 hours' notice.
SentiHome is a monitoring and advisory tool. It does not replace professional security or safety systems. Do not rely solely on SentiHome for life-safety decisions.
9. Limitation of Liability
To the maximum extent permitted by applicable law: SentiHome shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, property damage, or loss of profits, arising from your use of the Service.
Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or €50, whichever is greater.
EU consumers: Nothing in these Terms limits your statutory rights under EU consumer law, including rights regarding defective services or unfair terms.
10. Termination
We may suspend or terminate your account if you breach these Terms, engage in fraudulent or illegal activity, or fail to pay a valid invoice after 14 days.
You may delete your account at any time from account settings. We will process deletion within 30 days.
11. Changes to Terms
We may update these Terms. We will notify registered users by email at least 14 days before material changes take effect. Continued use after notice constitutes acceptance.
12. Governing Law and Disputes
These Terms are governed by Polish law. Any disputes shall be resolved in the courts of Gdańsk, Poland, unless EU consumer protection law requires otherwise.
EU consumers may also use the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr).
